Terms of Service

These terms cover your use of The Venue Menu ("TVM") and its companion app Prep Cooks. By signing in or using the service, you agree to them. If you use TVM for an organization, you confirm you may accept these terms for it.

The service

TVM is a customer-relationship tool for outreach to venues. It stores your venue and contact data, helps you plan and draft email, and, when you connect your Gmail, sends the emails you write or approve. TVM is operated by Christopher Paul Johnson (the "operator", "we", "us"). How we handle data is described in the Privacy Policy.

Accounts and territories

Your data lives in a territory. A territory owner manages the territory, invites other people, and sets their roles. You are responsible for keeping your sign-in details and second factor safe, and for what happens under your account. Tell us promptly if you think someone else has access.

Acceptable use

You agree to:

• Use TVM only for lawful business outreach.
• Not send spam, and not send email to people who have asked you to stop. You are responsible for following the email and privacy laws that apply to your outreach, including opt-out and consent rules. TVM provides tools such as a Do Not Contact list, but using them correctly is your job.
• Not try to break, probe, or overload the service, reach another territory's data, or resell access without our written agreement.
• Not put in data you have no right to use.

We may suspend access that breaks these rules or puts the service or other users at risk.

Your own Google and Anthropic accounts

TVM connects to your Google account and, for AI features, to your Anthropic account and API key. Those accounts are yours, and Google's and Anthropic's own terms and usage policies apply to how you use them. You pay Anthropic for the AI usage under your key. We are not responsible for those providers' services, limits, or changes.

Fees

Fees, if any, are as stated per the order form.

Your data

You own your data. You give us the right to process it only to run the service for you, as the Privacy Policy describes. You can export it at any time from Settings, Export Data.

Availability and no warranty

We work to keep TVM running, but we do not promise it will always be available or error-free. TVM is provided "as is" and "as available", without warranties of any kind, including fitness for a particular purpose. AI-generated text can be wrong; you are responsible for reviewing anything before it is sent.

Limitation of liability

To the fullest extent the law allows, the operator is not liable for indirect, incidental, special, or consequential losses, or for lost profits, lost business, or lost data. Our total liability for any claim relating to the service is limited to the fees you paid for the service in the 12 months before the claim arose. Nothing here limits liability that the law does not allow to be limited.

Termination and data export

You can stop using TVM at any time. We can end or suspend your access for a breach of these terms, or on reasonable notice. Before you leave, export your data from Settings, Export Data. After termination we delete your territory's data on request, as the Privacy Policy describes.

Governing law

These terms are governed by the laws of the State of New Jersey, and the courts in New Jersey have jurisdiction over disputes, unless the law requires otherwise.

Changes

We may update these terms. If a change matters, we will update the date and tell territory owners in the app. Using TVM after a change means you accept the updated terms.
